The Card Gnome website, located at www.cardgnome.com (“Site”), as well as all greeting cards, art, quotes, any other items, and services (individually, a “Product,” or, collectively, “Products”) related to the Site, are provided by Card Gnome, INC (“Card Gnome,” “we,” “us,” or “our”). We are committed to protecting our users’ (“you,” “User,” or “Users”) privacy. By browsing or using the Site, Products, or Content (defined below), you agree to be subject to this Privacy Policy (http://www.cardgnome.com/privacy) and our Terms of Use (http://www.cardgnome.com/terms). Content (“Content”) includes, but is not limited to, the text, User comments and submissions, graphics, artwork, photos, interactive features, and any other materials located on, accessed through, or contributed to the Site or Products. Please read this Privacy Policy carefully to understand what information we collect when you access the Site, Products, and Content, and how we store and use that information. If you do not agree with this Policy, you may not browse or use the Site, Products, or Content.

1. Information We Collect

a. Personal Information That You Provide

“Personal Information” is information that can be used to identify you, either directly or in conjunction with other information. It may include your name, mailing address or email address.

i. As a Guest User
You may browse the Site and purchase Products as a guest without creating an account. If you then purchase a Product to be delivered by US mail, you will be required to provide only a return mailing address for that Product.

ii. As a User via Facebook
You may login to the Site via Facebook by providing your Facebook user ID and password. If you then purchase a Product to be delivered by US mail, you will be required to provide a return mailing address for that Product.

iii. As a Registered User
If you choose to create an account (and therefore become a “Registered User”), you will be required to provide your first name, last name, and email address, as well as to create a username and password. In the future you may have the option of providing your birth date. If you purchase a Product to be delivered by US mail, you will be required to provide a return mailing address for that Product. The Content that you have viewed, indicated that you like, sent to a recipient, or received from another User will become part of your account history.

iv. As an Artist
A User who contributes Content that is artwork (an “Artist”) to the Site will be required to create a shop account in addition to the personal user account. Shop accounts require the Artist’s phone number, mailing address and personal biography.

v. Information About Other People
To send a Product to a recipient, a User must provide the recipient’s first and last name, as well as a delivery address, which currently is a mailing address, but may in the future be an email address or a Facebook ID. You may also include a personal message.
A User who logs in (via Facebook or via an account on the Site) may input and save contact information for potential and actual recipients of Products. This information may include first and last name, mailing address, email address, birth date, and other dates such as anniversaries. A User who logs in via Facebook may also import recipients’ contact information from Facebook, such as Facebook user IDs.

vi. Other Information
We will collect any and all other information that you submit to us, including via the Site, including, without limitation, comments, messages for personalizing cards, and email correspondence

b. Non-Personal Information Collected Automatically
Card Gnome will also collect information that does not directly identify a User. When using the Site, this non-Personal Information may include, but is not limited to, the website that referred a User, the IP address of the User’s computer, the computer’s browser type and language, access times, pages viewed, and links clicked.

2. How We Use Your Information
Card Gnome does not rent, sell, or trade any of its Users’ Personal Information. We use Personal Information for the purposes for which you provide it as well as to:
• Provide you with the products and services you order or request from the Site
• Create and manage Users’ accounts
• Provide customer service
• Respond to inquiries
• Process transactions, including sending a purchase confirmation via email
• Compensate Artists
• Tell you about our Products, promotional offers, and related information such as via an opt-in newsletter
• Send opt-in email reminders about upcoming holidays and a User’s contact’s upcoming birthday or special occasion
• Give Artists the opportunity to generate publicity around their listings and shops
• Compile anonymous, aggregated information that is useful to develop new features, improve the Site, Products, and Content, analyze trends and statistics, and ensure that the Site, Products, and Content remain relevant to Users’ needs
• Enforce our Terms of Use (http://www.cardgnome.com/terms), and otherwise detect, prevent, or address illegal or improper activity related to the Site, Products, or Content
• Comply with requests, including disclosure requests, from law enforcement officials
• Satisfy any applicably law, regulation, or legal process
• Protect the rights, property, or safety of Card Gnome, its Users, and the public
• Notify you of changes to other policies or terms that may affect you or your use of the Site, Application, or Products.

3. Business Transfers
We may also transfer or assign your information in connection with a merger, acquisition, consolidation, or sale of all or substantially all of our assets to a third party. In the unlikely event of our bankruptcy, insolvency, reorganization, or receivership, we may not be able to control how your Personal Information is handled. In all circumstances, we will make every reasonable effort to ensure that the acquirer of our data will abide by this Privacy Policy.

4. Information Disclosed To and By Third Parties
Card Gnome partners with third parties and we will share your Personal Information with them to the extent necessary to provide you with the Products and services that you request. For example, you may sign in to the Site via your Facebook account. If your Facebook security settings allow for it, we will retrieve all information you give us access to. You can also choose to share the birth dates of your Facebook friends. We may enable you to save addresses received from Facebook even if those addresses have been deleted from Facebook or we no longer have access to that information.

Card Gnome allows Users to purchase Products with a credit card. We share the User’s IP address, price paid for a Product, credit card number, CVC code, credit card billing address and billing name with Stripe. Stripe shares a reference ID, transaction status, price authorized, and transaction cost information with us and saves all credit card information securely.

Products purchased by a User and sent to a recipient via US mail are prepared, printed, and mailed by a third party. To fulfill a User’s order, we will share with this third party the recipient’s name and mailing address, the User’s mailing address, and, if applicable, a personal message selected or written by the User.

Card Gnome does not share a User’s Personal Information with any other User. This Privacy Policy does not cover information you choose to disclose to another User. This Privacy Policy also does not cover information you disclose directly to one of our third party partners.

Any links from the Site to other websites are provided solely for your convenience. Card Gnome does not endorse or control the privacy policies of third parties, and you are subject to the privacy policies of third parties where applicable. We encourage you to carefully review the privacy policies and terms of use of third parties with whom you interact.

5. Use of Cookies and Other Technologies
Card Gnome uses cookies (small text files placed on your hard drive) to enable you to log in to the Site and to help personalize your online experience. Some features of the Site and Products are only available through the use of cookies. If your browser permits it, you may decline cookies. If you choose to decline cookies, you may not be able to log in to or use interactive features of our Site or Products that depend on cookies, but you will be able to perform basic navigation through the Site.

In addition to cookies, we may use other technologies, including web beacons (single-pixel images) on our Site or in our emails or newsletters. These electronic images assist us in determining how many users have visited certain pages or opened messages or newsletters. We do not use these images to collect Personal Information.

Our third-party partners may also set cookies in order to improve your experience with the Site. For example, advertisers may set cookies in order to deliver customized advertisements that they believe will be of interest to you. We have no access to or control over these cookies. This Privacy Policy covers the use of cookies by Card Gnome only, and does not cover the use of cookies by third parties.

6. Security
If you choose to provide us with Personal Information, you consent to the collection, transfer, and storage of that information on our servers located in the United States. Card Gnome takes reasonable steps to protect that information, such as by encrypting credit card numbers using Secure Sockets Layer (SSL) technology. However, no system of electronic storage or method of transmission over the Internet is 100% secure. Therefore, we cannot guarantee absolute security of your Personal Information. Your account contains Personal Information and it is your responsibility to protect your account username and password. Do not share your password with any third parties. If your password has been compromised for any reason, please change it promptly and notify us immediately at support@cardgnome.com.


7. Minors
Card Gnome’s Site, Products, and Content are intended only for persons who are at least 13 years old. We do not knowingly collect information from persons under the age of 13. Persons under the age of 13 should not use the Site, Products, or Content or otherwise submit information to us without the consent of a parent or legal guardian. If we become aware that a person under the age of 13 has provided us with Personal Information without parental or guardian consent, we will take steps to remove such information and terminate that person’s account. If you are a parent or guardian whose child has created an account or otherwise shared information with us without the necessary consent, please contact us at support@cardgnome.com.

8. Modifying Your Personal Information
You may obtain a copy of, and request that we update or correct errors in, your Personal Information by emailing us at support@cardgnome.com. For your protection, you will be required to provide proof of your identity in order to obtain a copy of your Personal Information.

9. Closing Your Account
Upon your request, we will close your account and remove your stored Personal Information, subject to the following sentence, as soon as is reasonably possible. We do retain Personal Information from closed accounts in order to comply with applicable law, collect any fees owed, resolve disputes, enforce our Terms of Use, and take other actions otherwise permitted by law. Non-Personal Information that was collected incident to your prior use of the Site, Products, or Content will be retained. 10. Changes to This Privacy Policy
We may change this Privacy Policy from time to time and without prior notice. When changes are made, we will revise the “last updated” date at the beginning of this Privacy Policy. When material changes are made, we will also email the updated Privacy Policy to Users who have provided an email address and have not opted out of email communications from us. Additionally, a pop-up window will appear the first time a User logs in after this Privacy Policy has been materially changed; a User will be required to accept the updated Privacy Policy before completing the log in process. Guest Users will be required to accept the updated Privacy Policy before making a purchase. If you do not agree with the Privacy Policy, you must stop using the Site, Products, and Content. Continued use of the Site, Products, or Content constitutes acceptance of the most current version of this Privacy Policy, whether or not you have read that version.
